Man facing multiple felonies for selling a controlled substance to minors

Devon Tovar is facing three Class C Felony charges for delivery of controlled substance - Marijuana; two counts of possession with intent manufacture/deliver - marijuana; and a Class A Misdemeanor charge for unlawful possession of drug paraphernalia-manufacture-marijuana or tetrahydrocannabinol after his arrest.
According to documents filed with Northwest Judicial District, in October 2024 a “controlled buy” involving a CI instructed to purchase 28 grams of marijuana from Tovar in McKenzie County, was investigated by the Northwest Narcotics Task Force.
The CI was observed speaking with a male during the controlled buy that officers knew to be Tovar from previous law enforcement contact. The CI provided law enforcement with 28 grams of suspected marijuana. The 28 grams was divided into eight different plastic packages, each containing an approximate weight of three-and-a-half grams.
On Oct. 9, 2024, Law Enforcement executed an anticipatory search warrant on the 600 block of Hunters Run St., in Watford City, to search for illegal controlled substances, drug paraphernalia, and items/documents that show indicia of residency. The target apartment belonged to Tovar.
Tovar advised officers that there was going to be a small amount of marijuana located in the residence. Officers asked Tovar for consent to the search of the vehicles and Tovar’s garage.
Law Enforcement’s search yielded to the discovery of the following significant items:
Two packman hybrid suspected THC oil “apple jack” approximately four grams; one packman indica suspected THC oil “blackberry” approximately two grams; two packman sativa suspected THC oil “melon” approximately four grams; Five packman indica suspected THC oil “prune” approximately 10 grams; nine “California Honey” THC vape pens with approximately 18 grams of suspected THC oil; twenty-six “Mad Monkey” THC vape pens with approximately 52 grams of suspected THC oil; three bags labeled “2trill” “lemon cheesecake” with approximately 30 grams of suspected marijuana; one yellow “2trill” cheesecake package containing approximately one-and-a-half grams of suspected marijuana; one functioning black digital scale; one “2trill” cheesecake packaging with three grams of suspected marijuana located in the vehicle.
Tovar advised officers the reason he has marijuana in his residence is due to him trying to start a business in the future and is collecting inventory now. Tovar confirmed that the name of his company is “2TRILL.” There was multiple bags containing the “2Trill” logo on them. Tovar admitted to selling a “little bit” of marijuana in Watford City so people can know how good his product is going to be “once weed is legal.”
On Dec. 19, 2024, Officers were contacted by a Watford City Police Department School Resource Officer regarding an incident where a juvenile female was caught with a vape pen that tested positive of THC at Watford City Middle School.
Officers advised that a juvenile female identified as JVF-1, admitted to receiving the THC vape pen from juvenile male identified as JVM-1, at the Rough Rider Center (RRC). On Dec. 12, 2024, JVM-1 was reported to have received the THC vape pen from an individual upstairs in the RRC.
Officers obtained video surveillance and observed JVF-1, JVM-1 and an additional juvenile male, identified as JVM-2. During the video officer saw all three juveniles enter in the hockey wing of the RRC where JVF-1 waited in the lobby area and both juvenile males went outside and met with an individual driving a white jeep.
While at the white jeep, both juvenile males got into the backseat, then the jeep drove around the RRC parking lot, never leaving camera sight. The jeep then returned to the same area that it picked the two juvenile males up and dropped them off.
Both juvenile males went back into the RRC and met with JVF-1, who walked with both juvenile males to the downstairs area of the hockey wing in the RRC. While downstairs officers observed JVM-1 and a juvenile female identified as JVF-2 engage in what appeared to be a hand-to-hand transaction for a possible THC vape pen.
Law Enforcement conducted an interview with JVM-2 on Jan. 7, 2025. JVM-2 claimed not to know who the male in the Jeep that sold the THC vape pen was, other than him being referred to as “The Plug.” JVM-2 stated that he observed “The Plug” post that he was selling vape pens on his public Snapchat story.
Law Enforcement provided JVM-2 with two photos of different individuals,  he claimed to not be able to identify the driver of the Jeep, but claimed to know Tovar, who was in one of the photos. JVM-2 stated he recognized Tovar due his clothing line, and JVM-2 was trying to create his own clothing line.
JVM-2 re-approached Law Enforcement at a later time and advised that he had been thinking about the conversation from earlier. He showed the officer pictures from of the 2Trill Instagram account and identified the fade haircut of the person and said they also had a hand tattoo.
JVM-2 advised the person in the car had the same style fade haircut and a hand tattoo like the person in the pictures. He then positively identified the person in the picture as Tovar, confirming that Tovar was the person that was in the car that he purchased the THC vape from.
Tovar previously pleaded guilty to possession of controlled substance - THC on Jan. 24, 2024; pleaded guilty to possession of drug paraphernalia/manufacture - marijuana or tetrahydrocannabinol, Oct. 9, 2024; and currently has an open case for possession with intent to manufacture/deliver - marijuana from Dec. 4, 2024. All in McKenzie County, N.D.
Tovar’s bond was set at $50,000 and his Preliminary Hearing is set for March 27, 2025.
