Lobato sentenced to serve 8 years in prison

A sentencing hearing was held on Wednesday, Feb. 26, for Dylan Lobato, who pleaded guilty to a Class B Felony for burglary-night; a Class B Felony for theft-possession, $10,000-$50,000; a Class C Felony for terrorizing; and four Class A Misdemeanor charges in December 2024.
The presiding judge clarified with both the State of North Dakota and Lobato’s defense attorney, Kevin Chapman the sentencing agreement.
Lobato was sentenced to 10 years imprisonment, with 2 years suspended for each Class B Felony. These sentences will be served concurrently, meaning he will serve his time for both felonies at the same time at the Department of Corrections and Rehabilitation.
On the Class A Misdemeanor charges, Lobato was sentenced to 360 days imprisonment, with 273 days suspended and credit for time served of 87 days. He was also sentenced to five years imprisonment with four years and 273 days suspended on the Class C Felony.
During argument, Chapman requested to delay his client’s date of reporting to the McKenzie County Correctional Facility to begin his prison sentence until April 1, sighting medical care follow up needed.
The presiding judge, denied the request to delay the case any further. Lobato was taken into custody on Wednesday, in order to begin his eight year prison sentence.
He will have a three-year supervised probation period following prison, the court reserved the right to determine restitution within 90 days.
